Federal District Court

This was an action predicated on the Indian Non-Intercourse Act in which the Wampanoag Indians sought much of the land in the town of Gay Head on Martha’s Vineyard.  Stephen Schultz, while Administrative and Legal Counsel to the Massachusetts Attorney General, represented the Commonwealth of Massachusetts, who intervened in the case to prevent the giving away of the town land and private homes in the town, as a majority of the selectmen of the town were also members of the plaintiff tribe.  The case eventually settled through the passage of Congressional legislation.
